5. Frances ROBERTS was born about 1770 in Louisa Co, VA.42 She died before September 1801 at the age of 31 in Louisa Co, VA.109

Frances ROBERTS and David GILLASPIE were married on 20 January 1791 in Louisa Co, VA.27,110 On 20 December 1817 David GILLASPIE acquired 200 acres for $1300 at Cawthons Run in Louisa Co, VA111 Louisa County Court Records

This Indenture made and entered into this 20th day of De=
=cember 1817 Between Garrett M. Quarles & Mary his wife of the
one party, and David Gillaspy of the other part, Witnesseth
that said Quarles and wife for and in consideration of the
sum of Thirteen hundred Dollars to them in hand paid
the receipt whereof is hereby acknowledged, has bargained &
sold to said Gillaspy one certain tract of Land lying in
Louisa County on both sides of Cawthons run adjoining
the lands of John White & others supposed to contain
two hundred acres which Quantity is made up by one
hundred & fifty acres purchased by John Poindexter Dr
of John Kennon and fifty acres purchased by said Poind=
=exter of John White sd Quarles sells to Gillaspy that por=
tion bought of Kennon by the Antient and known Boun=
daries thereof, and that part bought of White by the
boundaries specified in a Deed from White of Poindexter
to said Gillaspy to him and his heirs forever : sd Quarles
sells to sd Gillaspy sd Land not by Survey but by estimation
nor does he warrant any Quantity sd Quarles and wife
for themselves and heirs do hereby Covenant and agree
to warrant to said Gillaspy and his heirs the title to said
land agreeable to the above specifications clear of the
claims of all persons whomsoever - In testimony where

I David Gillaspy of Louisa County of sound mind and disposing memory do constitute and ordain this my last will and testament hereby revoking all others wills by me heretofore made. 1st  It is my will and desire that all my just debts and funeral Expences should be paid out of my estate. 2ndly I lend to my wife Peggy Gillaspy all my estate both read and Personal until Eighteen hundred and forty to be kept together it is My desire that my son Nelson Saunders Gillaspy to be overlooker Or manager and to have a reasonable part of the crops but if My wife should die before eighteen hundred and forty it is my Desire that all my estate except my land should be divided Amongst my children as I shall hereafter mention but if My wife lives until eighteen hundred and Forty January 1st two thirds of my Estate except my land is to be equally Divided among all my Children nevertheless I lend to my Wife one third part of my Estate both real and personal During her natural life and at her death to be equally During her natural life and at her death to be equally Divided among all my Children except my land it is My wish and desire if any of my Children should marry Before my wife deth(sic) or Eighteen Hundred and forty my wife May giv(sic) them propity(sic) at valuation not to exceeding their legacy. 3  I give to my son Nelson Saunders Gillaspy all my tract of Land on both sides(sic) of big Corthern run on Condition that he Pays to the rest of my Children nine hundred dollars To be equally divided amongst them that is to say that He pays my son Morris Robert Gillaspy one hundred dollars On or before Eighteen Hundred and forty ~ That he pays to my son William Allen Gillaspy One hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my daughter Metilda Caroline Gillaspy One Hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my daughter Mary Elizabeth Gillaspy One Hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my son David Shelton Gillaspy One hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my son John Miner Gillaspy One hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my daughter Parthena Jane Gillaspy One Hundred Dollars on or before Eighteen hundred and forty ~That he pays to my son James Lindsay Gillaspy One hundred Dollars on or before Eighteen hundred and forty ~ That he pays to my 1` One hundred Dollars on or before Eighteen hundred and forty ~ if he do well and truly pay the above Children One hundred dollars to each as before mentioned the gift to be in full force and virtue to him and his heirs for ever but if he refuses to pay nine hundred dollars to be equally divided amongst the rest of my children as above mentioned the gift tobe void and of no effect and the land to be returned to my wife and at her death to be sold and divided with the dower equally among all my children hereafter mentioned. In Louisa County Court November 10th 1828
This paper writing purporting to be the last will and Testament of David Gillaspy decd was this day presented and Proved by the oaths of Jasper Grinstead and Moses White Two of the witnesses thereto and by the Court ordered to be Recorded. And on the motion of Nelson S. Gillaspy and William A. Gillaspy the Executors named in the said will Who made oath as the law requires and entered into and Acknowledged their bond in the penalty of four thousand Dollars conditioned according to law a Certificate is granted them for obtaining a probat of said will in due Form being permitted by the Court to qualify without Giving security according to the request of said will.
